In a recent Madras High Court Judgment, a Tahsildar who was suspended for bribery got relief on filmsy/technical grounds. The law says, a Govt servant can be suspended from the service if he was under custody for more than 48 hours. In this case, the individual was in custody for 24 hours when the suspension order was served upon. The Hon'ble Judge, however, gave liberty (!) to the Govt to suspend him afresh on the grounds of ''pending disciplinary action''. One has to follow-up this particular case as to whether the individual has been placed under suspension or he still continues to eat Govt funds as well as income through corruption!!!
An interesting case law!
